1. The employer/Recruiter must only upload jobs that are in existence, genuine and the subscriber has the authority to list them.
2. The Employer/Recruiter must not charge any fee from an applicant who responds to jobs advertised on Kamyabi.com for processing of the application.
3. Aforeserve.com Ltd reserves its right to change the look, feel, design, prominence, depiction, classification of any section of Kamyabi.com at any time without assigning any reason and without giving any notice.
4. Aforeserve.com Ltd offers no guarantee or warranties that there would be a satisfactory response or any response once the job vacancy is put on display.
5. Aforeserve.com Ltd may at its sole discretion include the vacancy intimated by client for display on Kamyabi.com in the print media through various media alliances in other print vehicles with no extra costs to the client. However, if a client wishes not to have its vacancies/requirement from appearing in print media, then the client shall specifically inform Kamyabi.com in writing accordingly at the time of intimating of the vacancy.
6. Aforeserve.com Ltd shall in no way be held liable for any information provided by the applicant to the subscriber and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense.
7. The User is prohibited to introduce, post or transmit any information or software, which contains a virus, worm or other harmful component into the internet or Kamyabi.com network system.
8. The User will not infringe on any intellectual property rights of any person or retain information in any computer system or otherwise with an intention to do so.
9. The User shall not to print, download, duplicate or otherwise copy, delete, vary or amend or use any data or personal information posted by any User on Kamyabi.com except such data and information which is posted by the particular User himself.
10. The User shall not violate, or attempt to violate the security of JobsAhead.com and/or any web sites linked to Kamyabi.com or gain un-authorized access any information regarded as private by other Users or persons, including but without limitation to accessing data and information not intended for them or logging onto a server or account which the User is not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication.
11. In the event that the User breaches any of the above mentioned covenants, and the Company becomes aware of such violation, the Company shall have the right to delete any material relating to the violations without prior notice to the User. The Company shall issue a warning to the User to discontinue any activity which leads to the said violations and in the event the User continues with such activity, the Company has the unilateral right to suspend or deactivate the User’s access to Kamyabi.com the Service and/or any other related facility. In addition to the right to indemnity available to the Company, the Company shall have the right to any legal remedy, against the User to recover the loss suffered by the Company and the harm caused to the reputation of the Company, due to such violation by the User.
12. The User will take all such measures as may be necessary (including without limitation changing his password from time to time) to protect the secrecy of his user Identification and/or password and shall not reveal the same to any other person(s).
13. There user identification is necessary to access the Service; the User shall use only his own user Identification.
14. In the event of theft or loss of user identification, password or security word, the User must notify the Company immediately by telephone and concurrently provide the Company with a written notice to that effect. The User shall remain liable for use of the Services by any third party until such theft or loss is notified to the Company.
15. The Company may at any time deactivate or suspend the User’s access to Kamyabi.com and/or the Services (as the case may be) without notice to carry out system maintenance, upgrading, testing, repairs and other related work. Without prejudice to the other provisions of this Agreement, the Company shall not be liable for any loss and damage, costs and expense that the User may suffer or incur, and no fees or charges payable by the User to the Company shall be deducted, refunded or rebated, as a result of such deactivation or suspension.
16. The company does not warrant that its web sites will operate error-free or that its web sites and its server are free of viruses or other harmful mechanisms. If use of the web sites or their contents result in the need for servicing or replacing equipment or data, by any user, the company will not be responsible for those costs. The company's web sites and their contents are provided on an "as is" basis without any warranties of any kind. To the fullest extent permitted by law, the company disclaims all warranties, including without prejudice to the foregoing, any in respect of merchantability, non-infringement of third party rights, fitness for particular purpose, or about the accuracy, reliability completeness or timeliness of the contents, services, software, text, graphics and links of the company's web sites.
17. All users use the company's web sites and any other web sites accessed through it, at entirely their own risk. All users are responsible for their own communications and are responsible for the consequences of their posting. The Company does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorses any opinions expressed by users. Any reliance by users on material posted by other users will be at their own risk. The Company reserves the right to expel any user and prevent their further access to the Company's Web Sites, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal or disruptive.
18. The Company's Web Sites may contain links to third party web sites. These are provided solely as a convenience to you and not in any way as an endorsement by the Company of the contents on such third-party web sites. If any user accesses any linked third party web sites, they do so entirely at their own risk. The Company is not responsible for the content of any third party web sites linked to its web sites and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party web sites. Further any material or details posted in the Company web sites by any user may be viewed by users of other web sites linked to the Company's web sites and the Company will not be responsible for any improper use by any user or third party from linked third party web sites of any data or materials posted on the Company's web sites.
19. The liability, if any, of Aforeserve.com Ltd is limited to the extent of the amount paid by the user.
20. Aforeserve.com Ltd or its associates will be free to send mailers, bulk emails to promote product and services and the same will not be treated as spamming. Aforeserve.com Ltd or its associates will also do Telecalling to promote products and services of its customers and the same will not be treated as illegal. Aforeserve.com Ltd may also sell the database to third parties for email marketing telecalling and mailer marketing.
